  • We turn teleworking into a complete experience and change the concept of work.
  • We facilitate the payment of accommodation. 
  • We answer your questions of any kind.

CONTENT AND USER BEHAVIOUR

As a client or user of the Website, you undertake to make appropriate use of the content and services offered through the Website and not to use them for:

  • Engaging in activities that are unlawful, illegal or contrary to good faith and public order.
  • Disseminate content or propaganda of a racist, xenophobic, pornographic, terrorist or human rights nature.
  • Causing damage to the physical and logical systems of JustMove, its suppliers or third parties, introducing or spreading computer viruses or any other physical or logical systems that could cause the aforementioned damage.
  • Disseminate contents that harm the image and reputation of JustMove or third parties.
  • Violate the rights of Intellectual Property, Industrial, image, honour or others that correspond to the OWNER or third parties.
  • THE OWNER shall have full freedom to decide whether the contributions and messages are finally published on the website or not, being entitled to remove them when it deems appropriate.
  • Infringement of any of the rules contained in these Terms of Use and, in particular, of the provisions of this clause, will entitle JustMove to immediately terminate your membership as a user or subscriber of the Website.

Terms and conditions: 

These terms and conditions apply to all possible services provided from our Website, whether direct or indirect. By accessing, browsing and using our website or any of our applications available through the Websites and/or making a booking, you agree that you have read, understood and agree to the terms and conditions below, including the privacy policy for data provided.

The content of these pages, as well as the booking service for the accommodation offered online, including the service for facilitating payments, are owned, managed and provided by JustMove and are made available to you for your personal, non-commercial use only, subject to the terms and conditions specified below. The relationship we have with our Suppliers is governed by different terms and conditions that make up a commercial relationship. Each Supplier acts in a professional manner with JustMove when offering its product on or through JustMove, taking into account the commercial relationship between companies and the relationship between the company and the consumer. Please note that Hosts may provide, declare applicable and/or request (the acceptance of), in addition to the conditions and fine print appearing on the website, their own terms and conditions (of delivery/shipping/transport/use) and rules of use, access and consumption of the Trip (which may include disclaimers of liability and limited liability).

Description of concepts:

JustMove is a registered trademark constituted by a single person under Spanish and European Union law with registered office at Calle Orellana Nº 1 Torrejón de Ardoz Madrid, Spain. 

The concept Website refers to the website hosting the products that are available for the various hosts to control, manage, maintain and/or host on justmoveltd. com. 

Host refers to the owner of the accommodation (tour operators, travel insurance and any other travel-related product or service that, from time to time, is available on the Website to book a trip).

Guest refers to the client, teleworkers or digital nomads who register on the Website with the aim of renting accommodation from our Host.

Travel Provision refers to the online shopping, ordering, booking or payment services (including the service to facilitate payments) offered or provided by JustMove with respect to various products and services that the Hosts make available on the Website from time to time.

Reservation refers to the request for information, purchase, payment or booking of a trip.

PROPERTY

The Website is a work composed of various integrated and inseparable elements (text, illustrations, photographs, animated images, videos, computer programs, including the html codes of the website, etc.), the Intellectual Property of which belongs to THE OWNER, except for material obtained under licence from third parties.

THE OWNER and its licensors retain at all times the Intellectual Property on the Website and on the different elements that compose it, individually considered, in all copies that are made (whatever the support on which they are incorporated), granting them only the rights of use that are described below. Any right not expressly granted is understood to be reserved.

In addition to the above, THE OWNER is responsible for the selection, design of the structure and layout of the contents of the Website, as well as for taking the initiative and assuming the risk of making the substantial investments aimed at obtaining, digitalising and presenting the same, thus corresponding to him/her the protection that article 12 and Title VIII of Book II of the Intellectual Property Law may grant on the website, considered as a database.

THE OWNER is also the sole owner of the design and graphic image of the Website, and reserves the right to take legal action against any person who imitates or makes unfair use of it.

 

  1. Scope and nature of our Service 

The Website offers an online service through which Hosts can advertise, advertise, sell, promote and/or offer their accommodation and services for request, purchase, booking, rental and through which visitors to the Website can search, compare, request, book, buy or pay. With them a contractual and binding relationship is established with the Host from which you have booked or from which you have purchased a product or service. From the moment a Booking is made, we act only as an intermediary. We transmit the relevant Booking data to the Host and send you a confirmation email on behalf of the Host. JustMoveltd.com is not the owner of the Accommodation, it only acts as an intermediary. It does not sell, rent or lend, it only interferes. 

The following information applies to customers in the European Economic Area, Switzerland and the United Kingdom. We ask Hosts worldwide to indicate to us by means of a self-declaration – in the context of EU consumer rights legislation – whether they act as a private host or a professional host. If a Host indicates to us that they are a private host, that Host will receive the label “Private” in the search results on the page and the following explanation will be added: 

“This accommodation is managed by a private individual. EU consumer rights legislation affecting professional hosts may not apply. Hosts who have registered with JustMoveltd.com as individuals are individuals who are renting out their accommodation(s) for reasons unrelated to their trade, business or profession. They are not professional hosts in legal terms (like a global hotel chain) and therefore do not fall under the same consumer protection rules as EU law. But don’t worry, JustMoveltd.com offers you the same customer service as with any other stay. This does not mean that your stay or experience will be any different than when you book with a professional host.

Hosts who are not labelled as private individuals are, according to EU consumer rights legislation, practising as professionals. The private individual qualification is only relevant for the purposes of EU consumer rights legislation and has no relevance for tax purposes, including VAT or any similar indirect tax incurred by reference to value added.

In providing our Travel Provision, the information is based on information provided to us by Hosts. Hosts enter their Accommodations on our Website which they access via an extranet, which they are fully responsible for updating the rates/fees/prices, availability, terms and conditions, and other relevant information that appears on our Website. While we try to make our Travel Provision as accurate as possible, we cannot verify or guarantee that all information is accurate, complete or correct. We are also not responsible for errors, interruptions due to temporary server outages or upgrades and maintenance of our Website, inaccurate, misleading, or missing information. Each Host is responsible at all times for the accuracy, correctness and accuracy of the information appearing on our Website. Our Website does not constitute and should not be seen as a recommendation or endorsement of the quality, level of service, rating of other guests, type of accommodation of any Hosts or their facilities, products or services available, unless explicitly stated or stated otherwise.

Our Travel Provision is made available for personal, non-commercial use only. Therefore, you may not resell, deep-link, use, copy, monitor, display, download or reproduce the content, information, software, reservations, products or services available on our Website for any commercial activity or purpose.

  1. Prices

The prices offered by the Hosts on our Website are designed and adapted to the exceptional conditions of the teleworker. All prices are shown inclusive of VAT, unless otherwise stated on our website or in the confirmed reply e-mail. 

It is likely that an accommodation is offered at different prices, this is due to the conditions of use, cancellation and/or prepayment that may be offered directly by the Hosts. It is recommended that you check all the details and conditions of the booking to make sure what these are.

We seek to adapt prices to the conditions and demands of teleworkers and digital nomads, trying to offer a quality service at an adapted price.

Obvious errors, including typos, are not binding.

  1. Privacy and cookies 

JustMoveltd.com respects your privacy. Please see our privacy and cookies policy published in the Cookies Policy and Privacy Policy section respectively, on the Website. 

  1. Payments and Transactions

Our service is free of charge for our Guests, unless otherwise stated, we do not charge for our Travel Provision and we do not add supplements to your booking price. You will pay the Hosts the amount indicated in the Reservation.

Hosts pay a commission to JustMove after the Guest has paid for the service. JustMove reserves the right to change service fees at any time, and will notify Hosts of any fee changes before they take effect. Changes in fees will not affect bookings made prior to their coming into effect.

For certain bookings such as bookings of 30 nights or more, JustMove may require the Guest to make regular and progressive payments to cover the Total Price of the Booking. Where applicable to a booking, more information about Regular Payments, including the amount and frequency of payment, can be found on the Website.

JustMove receives the full payment from the Guest (including VAT) and settles it with the Host according to the agreed conditions. 

The charge that a Host will receive for a Booking will be the Total Price minus JustMove’s service fee. In case of cancellation of a confirmed booking, JustMove will remit to the Guest the amount to be charged if any.

Only Hosts that have a business relationship with JustMove, through a contract, will be available on the Website. 

  1. Methods of Payment

Payment is processed securely from your credit/debit card, Paypal or from your account to JustMove’s account, which will settle the payment with the Host, as the owner of the accommodation. A secure online payment system is offered during the Booking. All payments provided by us to and on behalf of, and transferred to the Hosts shall in each case constitute a (partial) payment by you of the booking price of the relevant product or service as final settlement of each (partial) price due and payable. Once paid, such amounts cannot be reclaimed.

If available, some Hosts offer the possibility to pay for Reservations in full or in part (Regular Payments). 

  1. Prepayment, cancellation and no-show. 

By making a Booking with a Host, you agree to their cancellation and no-show conditions, as well as any additional terms and conditions of that Host that may affect your stay (including the Host’s “Please note” section made available on our Website and the relevant Host’s terms and conditions). This includes the services and/or products offered by the Host. Please check in advance the terms and conditions of delivery/purchase/use/transport of the Host with whom you make the Booking directly. The general cancellation and no-show conditions of each Host are available on our Website, both on the Host’s information pages and during the Booking process and in the confirmation e-mail or at check-in.  Please note that some rates do not allow changes or cancellations. In case of no-shows or cancellations with charges, the Host may apply the tourist tax.  Please check the details of each possible Reservation for conditions before making a Reservation. Please note that a Reservation requiring payment of a deposit or payment in advance may be cancelled, without notice, at such time as the outstanding amounts cannot be collected in full on the relevant date. Cancellation and prepayment conditions may vary according to the Reservation and the Host. Late payment, incorrect bank and credit or debit card details, invalid or insufficient credit or debit cards are the responsibility of the Booker and you may not be entitled to a refund or reimbursement of the prepayment, unless the Host accepts or permits this in its cancellation and prepayment terms and conditions.

If you wish to review, modify or cancel your booking, please refer to the confirmation e-mail and follow the instructions provided. Please note that cancellation fees may apply according to the cancellation, prepayment and no-show conditions. We recommend that you read these conditions carefully before booking and remember to make any subsequent payments on time as they may be required for the booking.

If you are going to arrive late or late on the day of check-in or if you arrive the following day, make sure you inform the Host in advance and in due time, so that they know when you will arrive and so that they do not cancel your Booking or charge you the supplement for no-show. If necessary, JustMove’s Customer Service department can help you inform the Host. JustMove is not responsible for the consequences of your delay or for any cancellation or no-show charge that the Host may make.

  1. Communication 

By making a Reservation, you agree to this:

  • An e-mail after arrival to evaluate your experience with the Hosts and the Service offered. 

 

  • An e-mail, once your stay is over, inviting you to complete a service evaluation form. See our privacy and cookies policy for more information about how we can contact you.

 

In order to complete and secure your Booking properly, you need to use a correct e-mail address. We are not responsible, nor do we have any obligation to verify any errors or misspellings in the e-mail address or any telephone number, preferably mobile or credit card number that is inaccurate or incorrect. It is the Guest’s responsibility to keep all such details up to date and accurate.  

JustMove disclaims any liability in connection with communication with the Host or through its website. You shall not obtain any rights from any request or communication with the Host, acknowledgement of receipt of any communication or request. JustMove cannot guarantee that the Host receives, reads, executes or accepts any request.

Any complaint or claim against JustMoveltd.com or in respect of the Travel Provision it provides must be made immediately, or at the latest, within 20 days after the scheduled date of the last day of the booking. Any complaint or claim submitted outside the 20 day period may be rejected and the complainant will forfeit any right to any compensation for damages or costs.

Notice to consumers in the European Economic Area: it is recommended that any complaints are first reported to us via Customer Services. If that does not resolve the problem, you may file a complaint through the European Union’s Online Dispute Resolution Website, which can be found at the following link, http://ec.europa.eu/odr.

Due to constant updates, price adjustments and availability, we recommend that you take screenshots when making a reservation in order to support your argument if necessary.

  1. Comments 

Customers who have stayed at the accommodation will receive an invitation from JustMove to comment on their stay at the accommodation concerned, rate aspects of their stay, or they may receive such a request to rate it during their stay. Customer comments including the review submitted during their stay may be sent to JustMove:

  • Upload yourself to the Host’s information page on our Website for the sole purpose of sharing your opinion on the level of service and quality of the Host with future teleworkers staying at the accommodation.

 

  • Use, partially or completely, at your discretion (marketing or promotion) on our Website or on RRSS, Newsletters, special offers, or other channels used or owned by the JustMove brand. 

 

In order to provide and maintain the most recent comments, comments can only be submitted within a limited period of 1 month after the stay. The default order of comments is by date of submission, although this may be altered by certain criteria. JustMove reserves the right to reject or delete comments solely on the basis that they do not comply with the comment conditions. JustMove does not compensate or offer any kind of compensation or reward to customers for adding a review. JustMoveltd.com undertakes to monitor and remove comments that are obscene, mention a personal name or refer to the theft of items.

JustMove will not allow comments that include, mention, promote or discuss: 

  • Illegal activities
  • Obscene expressions, violent, discriminatory or threatening content
  • Websites, e-mails, telephone numbers, credit card details
  • Political or controversial subject matter 
  • To specific individuals, or personal attacks on staff members

 

  1. Limits of Liability

Subject to the terms and conditions, to the extent permitted by law, we will only be liable for damages you suffer, pay or incur as a result of defects attributable to our obligations in connection with our services, up to the full amount of the cost of your Booking, as stated in the confirmation email, whether for one event or multiple events.

However, to the extent permitted by law, neither we nor any of our directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliates, licensors, agents or others involved in the creation, sponsorship and promotion of the Website and its contents shall be liable for: 

  • Punitive, special, indirect or consequential loss or damage, loss of production, profits, revenues, contracts, as well as loss or damage to customers or reputation and loss of claims. 

 

  • Errors related to the description of information including tariff and availability information on our website.

 

  • Of the services provided or products offered by the Host or other business partners.  

 

  • For any losses, damages or costs (direct, indirect, consequential or punitive) suffered, incurred or paid by you arising out of or in connection with the use, unavailability or delay of our Website. 

 

  • From any other personal or material injury such as, death, property damage, losses and expenses (direct or indirect, consequential or punitive) suffered, incurred or paid by you, whether arising out of (legal) acts, errors, breaches, (gross) negligence, professional misconduct of released, omissions, misrepresentations, misrepresentation, strict liability, in whole or in part, attributable to the Host, whose products or services are made available or promoted on our Website, including any partial cancellation, overbooking, overbooking, or any other breach of contract, defaults, misrepresentation, strict tort liability, wholly or partly attributable to the Host, whose products or services are made available, offered or promoted on our Website, including any partial cancellation, overbooking, strike, force majeure or other act beyond our control.

 

JustMove is not responsible and disclaims any liability for the use, validity, quality, relevance, suitability and disclosure of the Trip and makes no representations, warranties or conditions of any kind in this regard, whether implied, statutory or otherwise, including any implied warranty of merchantability, title, non-infringement or fitness for a particular purpose. You agree and accept that the relevant Host is solely responsible and liable for and assumes all responsibility and liability in respect of the Trip including any warranties and representations made by the Host. JustMove is not the re-seller of the Trip. Complaints and claims regarding the Booking, including all matters relating to the price offered, conditions or specific requests made by Customers, must be handled with the Host. JustMove is not responsible and disclaims all liability with regard to such complaints, claims and product obligations.

Whether the Host has charged you for your trip, or whether we facilitate the payment of the price, you agree that the Host is, at all times, responsible for the collection, withholding, remittance and payment of applicable taxes on the total amount of the price of the Booking to the relevant tax authorities. JustMove is not responsible for the shipment, collection, withholding, remittance or payment of taxes on the price of the product. JustMove does not act as an official seller of any product or service available on the Website.

By entering photos or other images into our system, you certify and confirm that you are in possession of the copyright and licenses of said image and that you agree to JustMove using it on its websites, social media and promotional materials, as well as in any publication that JustMove deems appropriate. You are granting JustMove a non-exclusive, universal, irrevocable, unconditional and permanent right and license to use, reproduce, show, have reproduced, distribute, sublicense, communicate and make available the images and content in any way that JustMove considers legitimate. By publishing these photos/images, you accept legal and moral responsibility for any and all legal claims made by a third party, including the Host, as a result of the use and publication of the photos/images by JustMove. JustMove does not own or endorse in any way the photos/images that are published. The veracity, validity and right of use of all photos/images will be assumed by the person who publishes the photo and will never be the responsibility of JustMove. JustMove denies any responsibility or liability for the published photos. The person who publishes them guarantees that they do not contain any malware, pornographic, illegal, obscene, offensive, censurable or inappropriate material, and that they do not violate the intellectual property, copyright or privacy rights of third parties. Any image that does not meet the aforementioned requirements will not be published and may be removed by JustMove without prior notice. 

JustMove and the Host may terminate the relationship for any reason (such as breach of contract or bankruptcy), with appropriate notice agreed between the parties.

  1. Intellectual Property 

The software necessary for our services, available and used by our Website as well as the intellectual property rights of the contents and information, as well as the material of our Website belong to JustMove, Cientoochenta.com and its Hosts.

JustMoveltd.com reserves exclusive ownership of all right, title and interest in the Website where the service is available, including Guest Comments and translated content, and is not authorized the right to copy, compile, link to, publish, promote, sell, integrate, embed, use, combine or otherwise utilize the content or our brand without written permission from us. To the extent that you wish to use our content, translated content, including customer feedback, or own any intellectual property rights in the Website or any content, translated content, or customer feedback, you hereby transfer and assign all intellectual property rights to JustMove. Any kind of misuse or any kind of action or behaviour mentioned above shall constitute an infringement of our intellectual property rights, including copyright and database right.

  1. Applicable Law, Jurisdiction and Dispute Resolution 

These terms and conditions and the provision of our services shall be governed by and construed in accordance with the Spanish law. Without prejudice to the chosen law, a natural person who uses any of our services for a purpose that can be considered outside his or her commercial or professional activity (hereinafter the “consumer”) may be subject to the mandatory provisions of the law of his or her country of habitual residence (i.e. the provisions which, according to the law of that country, must be applied irrespective of this choice of law clause; hereinafter the “Mandatory Provisions”). Any dispute arising out of these general terms and conditions and our services shall be settled solely by the competent Spanish Courts. Notwithstanding the jurisdiction clause, a consumer may also bring proceedings concerning the application of the relevant Binding Provisions in the courts of the country where he/she is domiciled, and proceedings against a consumer may only be brought in the courts of his/her country of residence. Notice for consumers in the European Economic Area: it is recommended that any complaints are first reported to us via Customer Services. If that does not resolve the problem, you may be able to file a complaint through the European Union’s Online Dispute Resolution Website, which you will find here: http://ec.europa.eu/odr.

The original Spanish version of these terms and conditions has been translated into other languages. The translated version is a courtesy and unofficial translation, therefore no rights can be derived from the translation. In the event of any dispute as to the content or interpretation of the terms and conditions, or in the event of any conflict, inconsistency or discrepancy between the Spanish version and the other language versions, the Spanish version of these terms and conditions prevails and is conclusive to the extent permitted by law. You may consult the Spanish version on our Website (by selecting the language) or ask us in writing to send it to you.

If any provision of these terms and conditions is or becomes invalid or unenforceable, you will continue to be bound by all other such provisions. Should this occur, the invalid provision shall be enforced to the fullest extent permitted by applicable law and, to the extent possible, a similar effect to that of the invalid or non-binding provisions shall be accepted, in accordance with the content and purpose of these terms and conditions.

  1. JustMove Experience and Partners

The JustMove Experience section on the Website shows a list of companies collaborating with JustMove distributed by islands. This list includes companies that offer complementary services to accommodation for teleworkers and whose information is published by JustMove on the Website but provided and authorised by the companies themselves. 

JustMove is not responsible for any problems that may arise from the contracting of services or products with such companies nor for any errors in the publication of some of the information. JustMove does not act as a re-seller of such services or products but as a reseller.

Customers and Guests may benefit from certain offers or promotions to be agreed with the companies participating in the JustMove Experience programme. 

In addition, the Partners section on the Website reflects companies related to JustMove’s activity, with the aim of supporting our community of people looking to telework away from home and grow with JustMove. These companies will provide information related to their activity, photos and other content that JustMove will have the right to use and publish on the Website. The JustMove community may benefit from special discounts and promotions that these companies publish on our Website. JustMove is not responsible for any problem arising from the contracting or purchase of products or services with our Partners.
